What happens to a work permit issued through marriage if the marriage is later determined to be a sham?
General information, not legal advice. For high-stakes decisions, confirm with the official institution in the next-step below, or consult a qualified Turkish lawyer.
Pending expert review. This fact is sourced but has not yet been reviewed by an independent legal expert. Treat as a starting point.
If public authorities determine that a marriage used as the basis for a work permit (under work-36 — the 3-year-marriage path) was an anlaşmalı evlilik (sham marriage), the work permit is cancelled under Implementation Regulation 6735 Article 56(1)(k).
Watch-outs
- Determinations come from anti-fraud investigations triggered by tip-offs, audit reviews, or routine status checks. There's no statute of limitations for the discovery.
- Beyond cancellation, the consequences cascade: criminal liability under Turkish law, deportation under Law 6458 Article 54(1)(c) for false documents in immigration applications, and a re-entry ban of up to 15 years under Law 6458 Article 9. See law-05.
- Genuine marriages don't carry this risk. The rule targets fraud, not unconventional relationships.
Next step
If you're in a genuine marriage but worried about a misclassification — different cultures, different living arrangements, age gap — document the marriage carefully from the start: joint addresses, joint accounts, shared activities, family and friend witness statements. The work to demonstrate authenticity is much smaller in advance than under investigation.
